Custody-Nom151 considerations

NOM 151 is a technical regulation of the Commercial Code that establishes the requirements for the conservation of data messages (electronic documents) and digitization of physical support documents such as contracts or agreements.

Some important characteristics are:

  • NOM 151 stipulates that the electronic signature is one of the fundamental requirements to issue a certificate of data retention.
  • When a document is signed with the electronic signature, it is accompanied by a digital certificate; through which the Certification Services Provider guarantees the identity of the signatory and that there have been no alterations.
  • Defines the elements necessary for digitization of physical documents.
  • The data message conservation certificate can be used in a legal dispute; it is always there to demonstrate that it is the original document and that there have been no alterations.
  • The NOM 151 stipulates that data message conservation certificates have a validity of 10 years according to numeral A.8.4 of the regulation.

This functionality will allow users to comply with the NOM 151 regulation in Mexico. It is configured using the parameter "nom151:true" in the endpoint POST /esign/v1/settings

A custody is generated when a signing process is completed.

Once this process is done, the user can request all the files and evidences together with the custody files, or only the custody files in the endpoint GET signature_request/{signature_request_id}/files. That could be used to verify the integrity of the evidences in the future.
